Late summer is a critical time for the mining and exploration industry. The deadline for Annual Mining Claim Renewals is September 1, and it arrives fast. Whether you’re a small-scale prospector or managing dozens of claims, it’s essential to ensure your filings, payments, or waivers are submitted to the Bureau of Land Management (BLM) on or before this date to avoid claim forfeiture.

WHAT IS AN ANNUAL MINING CLAIM RENEWAL?

An annual mining claim renewal, or annual maintenance fee, is required every year to keep your federal mining claim, mill site, or tunnel site active. The renewal must be completed on or before September 1 each year.

Mining laws include rules to reduce waste or unauthorized use of lands. For instance, some individuals may stake erroneous claims because they believe it may open a back-end route to getting approval for a home site or weekend retreat, etc. The annual claim renewal process helps reduce these claims and other purposes of trespass, encouraging and managing the proper use of public lands.

2025 Annual Claim Maintenance Fees

As of 2025, annual maintenance fees are:

  • $200 per lode claim, mill site, or tunnel site
  • $200 for each 20 acres (or portion thereof) of a placer claim

Failure to pay the full amount or submit a qualifying waiver by September 1 of each year will result in automatic forfeiture of the claim under federal law.

ANNUAL MAINTENANCE & ASSESSMENT WAIVERS

Even if you’re not paying the fee, you must still file appropriate documentation on time. Waiver applications must be submitted by September 1, 2025. Below are the four primary waiver types:

1. Small Miner’s Waiver

If you (and all co-claimants) own 10 or fewer claims or sites nationwide, you may qualify for a Small Miner’s Maintenance Fee Waiver.

To qualify:

  • Submit Form 3830-2 to your local BLM office by September 1
  • Pay a $15 processing fee per claim
  • Perform at least $100 of assessment work per claim
  • File an Affidavit of Assessment Work with the county and BLM by December 30, 2025

2. Soldiers’ and Sailors’ Civil Relief Act Waiver

Active-duty military personnel (and co-claimants) may qualify under the SSCRA.

To qualify:

  • Submit documentation of active-duty military service
  • Notify the BLM upon exit from active duty

This waiver remains in effect until six months after your military service ends and does not require annual reapplication unless circumstances change.

3. Reclamation Waiver

For sites undergoing final reclamation with no intent to resume operations.

To qualify:

  • Submit a certified or notarized statement confirming:
    • You are actively engaged in reclamation under 43 CFR Subparts 3802, 3809, or 3814
    • You do not intend to resume operations
    • Your reclamation plan has been submitted or approved by the BLM or relevant agency

This waiver is valid for one year. Reapply by September 1 annually.

4. Denial of Access Waiver

If you’ve been legally denied access to your mining claim (via court order or agency action), you may qualify for this waiver.

To qualify:

  • Provide official documents such as:
    • Declaration of Taking
    • Notice of Intent to Take
    • Official access denial from the surface management agency

Disapproval of a Plan of Operations does not qualify unless it includes explicit denial of access. This waiver is valid for one year and must be renewed annually.

WHAT IS AN ANNUAL MAINTENANCE & ASSESSMENT FEE?

All mining claims are subject to an Annual Maintenance Fee which must be paid on or before September 1 of every year. This is a strict date, as failure to timely pay the fee or file the waiver in the proper BLM office will subject your claims or sites to forfeiture of operation by law. The fee or waiver must be filed every year on or before September 1 to continue to hold the mining claim.

CAN I GET MY ANNUAL CLAIM FEE WAIVED?

If you own 10 or fewer non-closed claims or sites on Federal lands, you may qualify for a small miner’s waiver (see above). However, this waiver requires you to perform assessment work and spend a minimum of $100 in labor or improvements on each claim and record evidence of this on or before December 30 of the calendar year.

There are also special circumstance waivers, including being active military, undergoing claim/site reclamation, or receiving an official denial of access notice, that eliminate the annual fee. You can view these waivers above.

WHAT IF I MISS THE SEPTEMBER 1 DEADLINE?

Claims that miss the September 1 deadline are forfeited by law. The BLM has no discretion to accept late filings or payments. If forfeited, you may appeal to the Interior Board of Land Appeals (IBLA), but you’ll need to maintain all filing and work requirements during the appeal process.

HOW DO I PAY MY ANNUAL MAINTENANCE FEE?

Payments may be made:

  • Online via the Mineral & Land Records System (MLRS) (Note: Alaska claims must pay in person or by mail)
  • In person at your state BLM office (Fairbanks and Alaska State Office for Alaska)

By mail to your BLM state office (postmarked by the deadline)

When is the affidavit of assessment due?

If you filed a Small Miner’s Waiver, you must:

  • Perform at least $100 of assessment work per claim
  • File the Affidavit of Assessment with the county recorder where the claim is located and submit to the BLM by December 30, 2025
